Why do we think Curiosity found an old Mars riverbed?

The Curiosity rover team announced yesterday that they'd found the mission's first potentially habitable environment on Mars: an ancient river bed. But why do they think flowing water created the formation?

What exactly did the rover find?

Curiosity's telephoto camera snapped shots of three rocky outcrops not far from the rover's landing site inside Gale Crater. One of them, called "Goulburn", had been excavated by the rover's own landing gear. The other two were natural outcrops dubbed "Link" and "Hottah". All three, and Hottah in particular, were made of thin layers of rock that had been cemented together.

When the rover zoomed in, it saw rounded pebbles in the conglomerates and in surrounding gravel that were fairly large ? up to a few centimetres in diameter. On Earth, roundness is a tell-tale sign that rocks have been transported a long way, since their angular edges got smoothed out as they tumbled. The Mars rocks are too big to have been blown by wind, so the team concluded it must have been flowing water. This dovetails with orbital images hinting that the rover landed in an alluvial fan, a feature that is formed on Earth by water flows.

Let's not be H2O-centric here. Could the liquid have been something other than water?

The chemical evidence for hydrated minerals at Gale Crater and elsewhere means water is definitely the top contender ? although one team member likes to joke that, for all we know, the liquid could have been beer.

Some Mars scientists have suggested quickly evaporating carbon dioxide ice could have triggered rockslides, forming gullies elsewhere on the planet, but that's a less popular theory, says team member Sanjeev Gupta of Imperial College London. Also, such bursts of CO2 vapour probably couldn't have transported these rocks all the way from the rim of Gale Crater, where the river seems to have begun, adds Bill Dietrich of the University of California, Berkeley.

It's possible the water could have been quite salty or briny, which would make it more viscous. It could have been slushy or icy as well. "Whether pure water or salty water, it would all behave similarly in terms of sediment transport," says team member Rebecca Williams of the Planetary Science Institute in Tucson, Arizona.

How long ago was the water there?

On Earth, the most reliable way to measure the ages of alluvial fans is by radiocarbon dating ? but that requires organic carbon, which we haven't yet found on Mars. And even if it found some, Curiosity's on-board chemistry lab isn't quite up to the task. The best Mars scientists can do is estimate the age of the surrounding surface based on counting craters. On a large scale, the older an area is, the more craters it likely accumulates over time.

"We think what we're looking at is several billion years old," Dietrich says of the region around Gale Crater. "How to get better than that, I don't know. This is a common discussion point."

How deep was the stream? How fast was it flowing?

Dietrich calculated that it was probably between ankle and hip deep, and flowed at about a metre per second.

How can he possibly know that?

The key was knowing the size of the rocks: "Up until now, no one knew what the size of the material in the bed was," Dietrich says. "That affects when grains start to move and the velocity. It propagates through all the calculations."

The equations for calculating river depth on Earth apply just as well on Mars, despite Mars' weaker gravity. The amount of water needed to push a rock down a slope depends on the weight of the rock and the steepness of the slope. The team knew the slope's angle, at least roughly, based on measurements of Gale Crater taken from orbit. Curiosity's new images gave size estimates for the rocks, which translated to a range of depths. Then Dietrich could plug the depth into equations for flow speed, which do depend on gravity. The river flows more slowly on Mars than it would on Earth, he says.

Its speed could change depending on how cold the water was ? cold water is about twice as viscous as warm water. Another uncertainty is how dirty the water was, since carrying a lot of small particles would slow down the stream. With the data we have now, though, a metre per second is a pretty safe estimate, Dietrich says. "Based on a mixture of hydraulic calculations and field experience, this is typically what we would find."

What does this mean for life?

The team's project scientist, John Grotzinger of Caltech, called the river bed the rover's first potentially habitable environment.

"But these fluvial environments aren't the best habitable environments," Gupta says. "They're not the best at preserving evidence of life." That's part of why the rover has already left the outcrops behind and is now heading first toward a spot called Glenelg, where three different rock types come together, and then full speed towards the mountain in the middle of the crater, alternately called Aeolis Mons or Mount Sharp. Orbital images show tantalising evidence of clays in the mountain's layers, and clays are known to better preserve organics.

"The longer-term aim is to get to Mount Sharp," Gupta says. "That's always on our mind. We can't get too distracted."

But if they run across something else that's more exciting on the way, might they change course?

"Absolutely!" says Williams. "This mission is responsive to discoveries."

Tea party star West uses opponent's mug shot in ad

WASHINGTON (AP) ? In a bid to hold onto his House seat, freshman Republican Rep. Allen West is making his opponent's bleary mug shot from nine years ago the focus of a blistering ad.

On a single night in February 2003, the ad released Friday notes, West was on an Army base in Texas, preparing to go to war. College student Patrick Murphy, meanwhile, was being arrested outside a Miami-area nightclub after an alleged drunken brawl, the ad says.

"Two men, a country in crisis. You decide," says a narrator.

The ad from the Florida tea party star uses dramatic music and visuals of a scope's crosshairs to emulate a high-tech spy flick. Murphy's mug shot plays a prominent role in the spot.

Murphy's campaign responded by pointing out that Murphy was just 19 when he was arrested and that West was later reprimanded for his conduct in Iraq and was 42 at the time.

"The only reason (West) escaped prosecution was that he cut a deal to retire," Murphy campaign manager Anthony Kusich said in a fundraising letter Friday.

West is one of the most fiery members of the 2010 freshman class that helped Republicans take control of the House. He's one of several first-termers struggling to defend their seats after a two-year session of gridlock and infighting that dropped Congress' approval ratings to record lows. The GOP is expected to hold the House, but by a smaller margin.

West is a top Democratic target this year, in the party's drive to gain 25 seats and the House majority.

The release of the ad hints at the cutthroat nature of the race.

West won his seat in 2010 on his second go for the House, unseating Democratic Rep. Ron Klein in a competitive district. The race attracted President Barack Obama, who appeared on Klein's behalf, but it wasn't enough to spare the incumbent during a tough year for Democrats.

In 2012, conditions are tougher for West as he fights for a second term. Mapmakers in the once-per-decade redistricting process redrew West into a more Democratic district, and he opted to run for re-election in a different district to improve his prospects. But the new turf where West is squaring off with Murphy is winnable for both parties. Murphy, a CPA, has attempted to paint West as too extreme for Florida, and has gotten a hand in fundraising from former President Bill Clinton.

Murphy's adviser, Eric Johnson, said it was ironic that West would bring up his own military record in an ad hitting Murphy on legal issues. West, a lieutenant colonel, was reprimanded by the military for allegedly firing a pistol next to an Iraqi's head as he attempted to extract information from the detainee. He was fined $5,000 but allowed to retire with full benefits.

Murphy got some backup from the House Majority PAC, a group backing Democratic House candidates across the country, which released an ad Friday that amounts to a greatest-hits reel of West's more controversial statements, including one earlier in 2012 in which he estimated that about 80 House Democrats are Communists. The political action committee said it is spending $1.5 million on Florida airwaves attacking West.

Although Democratic prospects for reclaiming the majority in the House seem dim, Florida is home to many of the party's better opportunities to pick up seats. The Democratic Congressional Campaign Committee has spent about $250,000 tying West to Rep. Paul Ryan, Republican presidential nominee Mitt Romney's running mate.

Video: Simulations uncover 'flashy' secrets of merging black holes

Friday, September 28, 2012

According to Einstein, whenever massive objects interact, they produce gravitational waves -- distortions in the very fabric of space and time -- that ripple outward across the universe at the speed of light. While astronomers have found indirect evidence of these disturbances, the waves have so far eluded direct detection. Ground-based observatories designed to find them are on the verge of achieving greater sensitivities, and many scientists think that this discovery is just a few years away.

Catching gravitational waves from some of the strongest sources -- colliding black holes with millions of times the sun's mass -- will take a little longer. These waves undulate so slowly that they won't be detectable by ground-based facilities. Instead, scientists will need much larger space-based instruments, such as the proposed Laser Interferometer Space Antenna, which was endorsed as a high-priority future project by the astronomical community.

A team that includes astrophysicists at NASA's Goddard Space Flight Center in Greenbelt, Md., is looking forward to that day by using computational models to explore the mergers of supersized black holes. Their most recent work investigates what kind of "flash" might be seen by telescopes when astronomers ultimately find gravitational signals from such an event.

Studying gravitational waves will give astrophysicists an unprecedented opportunity to witness the universe's most extreme phenomena, leading to new insights into the fundamental laws of physics, the death of stars, the birth of black holes and, perhaps, the earliest moments of the universe.

A black hole is an object so massive that nothing, not even light, can escape its gravitational grip. Most big galaxies, including our own Milky Way, contain a central black hole weighing millions of times the sun's mass, and when two galaxies collide, their monster black holes settle into a close binary system.

"The black holes orbit each other and lose orbital energy by emitting strong gravitational waves, and this causes their orbits to shrink. The black holes spiral toward each other and eventually merge," said Goddard astrophysicist John Baker.

Close to these titanic, rapidly moving masses, space and time become repeatedly flexed and warped. Just as a disturbance forms ripples on the surface of a pond, drives seismic waves through Earth, or puts the jiggle in a bowl of Jell-O, the cyclic flexing of space-time near binary black holes produces waves of distortion that race across the universe.

While gravitational waves promise to tell astronomers many things about the bodies that created them, they cannot provide one crucial piece of information -- the precise position of the source. So to really understand a merger event, researchers need an accompanying electromagnetic signal -- a flash of light, ranging from radio waves to X-rays -- that will allow telescopes to pinpoint the merger's host galaxy.

Understanding the electromagnetic counterparts that may accompany a merger involves the daunting task of tracking the complex interactions between the black holes, which can be moving at more than half the speed of light in the last few orbits, and the disks of hot, magnetized gas that surround them. Since 2010, numerous studies using simplifying assumptions have found that mergers could produce a burst of light, but no one knew how commonly this occurred or whether the emission would be strong enough to be detectable from Earth.

To explore the problem in greater detail, a team led by Bruno Giacomazzo at the University of Colorado, Boulder, and including Baker developed computer simulations that for the first time show what happens in the magnetized gas (also called a plasma) in the last stages of a black hole merger. Their study was published in the June 10 edition of The Astrophysical Journal Letters.

The simulations follow the complex electrical and magnetic interactions in the ionized gas -- known as magnetohydrodynamics -- within the extreme gravitational environment determined by the equations of Einstein's general relativity, a task requiring the use of advanced numerical codes and fast supercomputers.

Both of the simulations reported in the study were run on the Pleiades supercomputer at NASA's Ames Research Center in Moffett Field, Calif. They follow the black holes over their last three orbits and subsequent merger using models both with and without a magnetic field in the gas disk.

Supercomputer models of merging black holes reveal properties that are crucial to understanding future detections of gravitational waves. This movie follows two orbiting black holes and their accretion disk during their final three orbits and ultimate merger. Redder colors correspond to higher gas densities. Credit: NASA's Goddard Space Flight Center

. Cowperthwaite, Univ. of Maryland

Additional simulations were run on the Ranger and Discover supercomputers, respectively located at the University of Texas, Austin, and the NASA Center for Climate Simulation at Goddard, in order to investigate the effects of different initial conditions, fewer orbits and other variations.

"What's striking in the magnetic simulation is that the disk's initial magnetic field is rapidly intensified by about 100 times, and the merged black hole is surrounded by a hotter, denser, thinner accretion disk than in the unmagnetized case," Giacomazzo explained.

In the turbulent environment near the merging black holes, the magnetic field intensifies as it becomes twisted and compressed. The team suggests that running the simulation for additional orbits would result in even greater amplification.

The most interesting outcome of the magnetic simulation is the development of a funnel-like structure -- a cleared-out zone that extends up out of the accretion disk near the merged black hole. "This is exactly the type of structure needed to drive the particle jets we see from the centers of black-hole-powered active galaxies," Giacomazzo said.

The most important aspect of the study is the brightness of the merger's flash. The team finds that the magnetic model produces beamed emission that is some 10,000 times brighter than those seen in previous studies, which took the simplifying step of ignoring plasma effects in the merging disks.

"We need gravitational waves to confirm that a black hole merger has occurred, but if we can understand the electromagnetic signatures from mergers well enough, perhaps we can search for candidate events even before we have a space-based gravitational wave observatory," Baker said.

Germany's jobless rate falls to 6.5 percent

BERLIN (AP) ? Germany's jobless rate fell to 6.5 percent in September thanks to a traditional seasonal improvement, official figures showed Thursday.

Still, the underlying trend continued to drift higher, underlining concerns that Europe's biggest economy is slowing down as economic problems around the euro area dent demand for German exports.

The Federal Labor Agency said the unadjusted jobless rate was down 0.3 percentage points compared with August, and that the number of people registered as unemployed was 2.788 million ? the lowest overall jobless figure for September since 1991.

The figure was 117,000 lower than the previous month and 7,000 lower than September last year.

When adjusted for seasonal factors the unemployment rate remained steady at 6.8 percent, where it has stood for several months, and the number of jobless rose 9,000 over August, the sixth straight rise.

The end of the summer holidays usually sees a batch of new hirings.

"The weaker economic development is affecting the job market, though overall the job market remains robust," the head of the labor agency, Frank-Juergen Wiese said.

Many analysts think unemployment could edge up over the coming months as the manufacturing sector, the heart of the German economy, struggles in the face of waning demand around Europe.

"Vacancies continue to drop, the share of temporary jobs in total vacancies is increasing and several companies have reintroduced short-time work schemes," said Carsten Brzeski, an economist with ING in Brussels. Such government-subsidized programs, which allow employers to reduce production without cutting their workforce, were credited with keeping unemployment down during the 2008-9 financial crisis.

Germany is still doing far better than many other countries in the 17-nation euro area. Unemployment is above 20 percent in Spain and Greece.

Search Forex ? Blog Archive ? Foreign Exchange Advice To Help ...

Are you interested in becoming a currency trader? Here?s your chance! You may have many questions about how foreign exchange works, but this article will help clear up any questions you may have. This article will provide you with some excellent tips for beginning foreign exchange trading in the right way.

You should be aware that the foreign exchange market does not have a centralized location. This protects the foreign currency markets from getting shut down or ruined by a natural disaster. Just because an emergency or disaster occurs doesn?t mean you need to close out all of your trades. A major event may affect the market, but will not necessarily affect your currency pair that you are working with.

When you make money, be sure to celebrate your success. If you?ve made some profitable trades, consider sending your broker a withdrawal order so you can cash out some profits. Try to focus on the reasons you invested in the first place. What do you want to finance?

Make sure that you are the one to stay on top of your trades. While it may be tempting to use software to monitor your trades, monitoring them yourself is a better way to protect your investments. Forex trading is based on a numbers system. However, the smartest and most successful trading choices are made by intelligent, dedicated, and insightful human beings.

TIP! Once you?ve become comfortable with your current methods of trading, consider mixing it up and giving scalping methods a chance. This involves making a number of small trades in a short time period.

Fibonacci Levels

There are many aspects to trading that are important to learn, such as Fibonacci levels. Fibonacci levels can help you to make decisions about trading. Fibonnacci levels can guide you towards the best exits.

You should vet any tips or advice you receive regarding the Foreign Exchange market. An approach that gets great results for one person may prove a disaster for you. You have to develop the ability to discern changes in technical signals yourself and now how to reposition appropriately.

Create a plan. Without a solid, informed trading plan, you are likely to encounter difficulties in generating profits. You should come up with a plan you can stick with so you will not be tempted to make trades based on your feelings, which can make you lose money.

TIP! Do not buck the trends when you are new to the trade market. Don?t try picking the highs and lows of the market either.

Keep an eye on all of the relevant financial news. The news usually has great speculation that can help you gauge the rise and fall of currency. If you have a email or text alert service they can keep you updated on news.

Generating money through the Forex market can cause people to become overconfident and make careless trades. The same thing can happen when a person panics. Work hard to maintain control of your emotions and only act once you have all of the facts ? never act based on your feelings.

Beginners are often tempted to try to invest all over the place when they start out in forex trading. You should stick with one currency pair while you are learning the basics of trading. However, you should avoid doing this until you begin to have more knowledge about all the different markets so that you won?t suffer giant losses.

It?s actually best to do the opposite. You will find it less tempting to do this if you have charted your goals beforehand.

TIP! You should learn to read the market for yourself, and make your own analyses. Success in Forex trading requires the ability to make your own decisions, based on a thorough knowledge of the market.

Do not over complicate things. Avoid trying to jump into a system that is overly complicated, as this will only make it harder. In the beginning, it?s best to only use the methods that are simple and also work well for you. As you become more experienced, you can expand on your knowledge. Try to come up with ways to expand upon your base of knowledge.

Remember that on the foreign exchange market, up and down patterns will always be present, but there will only be one dominant pattern at a time. Finding sell signals is easy when there is an up market. You should tailor your trading strategy to current market trends.

Foreign Exchange

Come up with clear, achievable goals, and do all you can to reach them. If you decide to start investing in forex, set a goal for yourself as well as a timetable for achieving that goal. When you are new to trading, keep in mind that there is room for error. You should determine the amount of time you can dedicate to learning forex and performing research in addition to trading.

TIP! Limit your losses on trades by making use of stop loss orders. A lot of Forex traders won?t exit a position, hoping that the downward trend will reverse itself.

Foreign Exchange marketing holds many advantages over other investment and money making schemes. You can trade any time of day since it is available 24/7. You do not need large sums of money to get in on opportunities with foreign exchange. The forex trading market is accessible to nearly anyone at anytime.

Select a trading style based on your priorities. If you do not have time to watch the market constantly, use delayed orders or invest over a longer time frame rather than relying on day trades.

Do not change the place in which you put stop loss points, you will lose more in the long run. Have a set strategy and make sure to abide by it.

Some people think that the stop losses they set are visible to others in the market. They fear that the price will be manipulated somehow to dip just below the stop loss before moving back up gain. This is not true, and you should never trade without having stop loss markers.

TIP! You need to be able to customize your automated trading system. The software needs to be changeable to suit your needs.

Use online search engines to come up with a list of trustworthy brokers, as well as a list of those to avoid. You can find a lot of useful tips about brokers on Forex forums. Use this knowledge to choose a good broker so that you can avoid losing profits.

These tips will allow you to understand forex better, and make better trading decisions. This will allow you to work more effectively and make a better profit. We hope these tips will help you begin in foreign exchange and help carry you through to trading at a professional level.

Genealogy News in Bloomberg Businessweek ? Irish Genealogical ...

An article on Ancestry.com appears in the Sept 24-30 issue of Bloomberg Businessweek.?According to the story,?genealogy ranks second only to porn?as the most searched topic online?? Perhaps less surprising was their report that visitors to online genealogy sites are mostly white women, 55 and older, who browse the Internet from home. Those were two of the statements made by the article. Here are?a few more highlights:

  • President Barack Obama is related, through his white Kansan mother, to one of the earliest slaves in North America.?Obama is also related to Brad Pitt (eighth cousins) and Warren Buffett (seventh cousins, three times removed). Discoveries like these are the work of a subsidiary of Ancestry.com called ProGenealogists.
  • The company?s celebrity research strategy is key to generating buzz. ?Ultimately, yeah, it?s a branding play,? admits Ancestry.com?s PR director. ?The more relationship stories you hear, the more you might be thinking about researching your own family.?
  • Ancestry began in 1983 as a small niche publisher of reference books and has since?grown to have a near monopoly?in the family tree business. Ancestry will net a projected $480 million in 2012, up 189 percent over the last five years.
  • Although market leader, Ancestry.com is not the genealogy industry?s only player. Several for-profit outfits such as MyHeritage.com and Brightsolid are busy building out their collections, but Ancestry.com mostly competes with itself: It owns five of the top 10 genealogy sites on the Net, including RootsWeb.com, Genealogy.com and Archives.com.
  • If you assume families have two kids, each parent will have two children, four grandchildren, eight great-grandchildren, 16 great-great-grandchildren and so on. After 10 generations, or about 250 years, the average person will have 1024 descendants. The article says practically all people of European descent share at least one common ancestor on their family trees sometime within the last 550 years.
  • A computer science professor/genealogy enthusiast was quoted: ?Say you walked into an ancient Egyptian village in 2000 BC and interrupted a peasant making love to his wife, delaying him for five minutes. Then Hitler, Stalin, Charles Darwin, Winston Churchill, Alan Turing, Jane Austen, Abraham Lincoln, name whoever you want, would not exist. They could not exist.??The expert?explains that a different sperm would have won the race, perhaps producing a son rather than a daughter, and the future of the world would be forever changed.

What Staples' Implosion Means For Retail - Business Insider

Today, Staples scrapped the way it runs its business. It's going to try something totally different.

Staples announced this morning that it is?"embarking on a strategic plan to better serve the needs of its customers and accelerate growth."

It's going to?close or downsize dozens of stores, make leadership changes,?increase investment in online and mobile (funded by a $250 million cost-savings plan), combine its U.S. retail and Staples.com businesses and totally reorganize its international operations.

You can read the full release, which describes Staples' plan in more detail, here.

It's making bold moves, and something drastic had to be done to turn things around. Staples posted sales declines the last two quarters and purchasing trends continue to shift online.

What does this all mean?

"The days of hawking non-essential commodity goods inside humongous square footage are long gone," writes Brian Sozzi, chief equities analyst at NBG Productions, in a note this morning.

"Yet, there is this feeling that brick and mortar names without unique experiences or traffic driving offerings (think food) are only stalling the inevitable by closing under-performing locations as opposed to repositioning for a future of success."

Here are four more big messages taken away from Staples' big announcement. From Sozzi:

  • Staples is prepping for the inevitable merger of Office Depot and Office Max.
  • Staples has given the market a taste of what the new CEO of?Best Buy?has to do in terms of a restructuring plan; basically he has to go above and beyond the overhaul plan articulated by his predecessor?Brian Dunn.
  • In a world where people ?queue? for iPhones and iPads, other hardware players are bringing forth strong mobile innovation of their own, and as Square fetches a $3.25 billion valuation after a cap raise, there is need like never before for certain big box retailers to accelerate store closures.?Should be an interesting post-holiday season in this regar
  • JCPenney?s 360 degree metamorphosis designed to create experiences built around commodity goods sure looks like something that could work (though this is not yet a reason to buy the stock).

First, Do No HARM by Philip Corwin ? DomainPulse.com ? The Beat ...

Internet Commerce Association logoIs it really less than a week ago that Melbourne IT (MIT) hosted a Washington, DC forum on ?Trademarks and New gTLDs?? The calendar says that it was, but intervening events make the discussion that took place feel outdated already ? given that the one item on which there was clear consensus among almost all event participants (ICANN moving forward with implementation of Uniform Rapid Suspension (URS)) appears to be launching, while ICANN?s new CEO subsequently sent a letter to Congress throwing cold water on two key items in the brand community?s wish list.

The focus of the event was supposed to be MIT?s High At-Risk Marks (HARM) proposal, which envisioned a circumscribed set of global, non-generic word trademarks receiving a higher level of required rights protection in new gTLDs. While we had strong concerns about some aspects of the HARM trial balloon ? especially the notion that a URS brought against a HARM-listed mark would bring automatic domain suspension if the registrant did not pay a response fee within 48 hours ? we nonetheless commend MIT for putting a well-reasoned and circumscribed proposal out for consideration. But the day?s discussion ranged far beyond HARM, especially after brand representatives at the event made clear that its requirements were too restrictive for their taste. This led MIT CTO (and ICANN Vice Chair) Bruce Tonkin to remark post-event, ?There doesn?t seem to be enough support for line-drawing.? So HARM, R.I.P., we hardly knew you.

Mr. Tonkin kicked off the event with remarks that the Applicant Guidebook (AG) contained a ?minimum set of protections? and that ?now is the time to review the mechanisms in light of the TLDs applied for?. Most of the panelists chosen for the event represented brand interests and made predictable arguments for significant expansion of the breadth of listings in the Trademark Clearinghouse (TMC) and the length of its operation, as well as for converting URS from a limited supplement to the existing UDRP to a full-bore substitute, at a much cheaper price for complainants at the expense of cheapening registrant rights.

But some of the comments did surprise us, such as that of Dan Jaffe of the Association of National Advertisers (ANA), a group that had hoped to delay the acceptance of new gTLD applications. Mr. Jaffe declared that ?there is no URS at the present time?, which is certainly news to us as well as everyone else in the ICANN community who had debated its contours at extended length. We were also taken aback by Andrew Abrams of Google, who gave an interesting presentation on the various business models contained within its 98 gTLD applications ? but them went on to endorse changing the URS by lowering its burden of proof to the same as a UDRP, and to imposing a
?loser pays? rule on the registrant of even a single domain at issue. When the time came for audience comment ICA pointed out that this was a rather confounding endorsement from Google, which had helped lead the fight against the SOPA legislation for the exact reason that it would subject domains to suspension aka ?censorship? based upon allegations of IP violations but absent adequate due process for registrants. Our post-event conversation with Mr. Abrams indicated that Google may reexamine its URS position.

One panelist who stood out from the crowd was Jon Nevett of leading gTLD applicant Donuts, who made a strong argument that the AG should be considered closed and that any new rights protection mechanisms (RPMs) should only be considered in the context of a policy development process (PDP) applicable to all gTLDs. ICA, for its part, has long been on the record favoring initiation of a PDP for procedural UDRP reform, but it was pressure from brand interests that have deferred its start until at least mid-2015. Mr. Nevett pointed out that Donuts has additional rights protections baked into its applications, such as a Domain Protected Marks List (DPML), and made the case for allowing such experimentation by applicant groups to test the efficacy of such measures before even thinking about requiring them from all.

When the discussion was opened to the audience, ICA noted that the existing RPMs came out of a two year ICANN community debate and were unanimously endorsed by the GNSO Council and the ICANN Board, so they shouldn?t be casually tinkered with ? while not rejecting all proposals out of hand, we think there has to be a mighty high bar for any alterations.

As for the major brand rationale for performing RPM surgery ? that there were 1400 unique gTLDs being applied for ? we pointed out that by the time the Board approved the existing measures there was an expectation of at least 500-1,000 applications, and that the existing RPMs do scale for whatever number of new gTLDs come into being. We also made clear that since the URS had been adopted on the basis that it was to be a limited supplement to the UDRP, we?d strongly oppose any bait-and-switch attempt to convert it into a cut-rate UDRP substitute.

From other comments, it was also clear that many applicants, registries, and registrars were very concerned by any proposed alteration of the TMC warning system that would result in an inordinate number of false positives. The trademark for insurance company ING came in for several mentions, since any TMC registration warning system triggered by the multiple words containing such a trademark ? such as domaining ? could scare off potential registrants in droves.

As noted, the one item on which all parties seemed to agree was that ICANN was way overdue on URS implementation. Perhaps not coincidentally, the very next day an ICANN e-mail properly delegated control of URS implementation to the GNSO Council (see http://internetcommerce.org/URS_Implementation), with this to be a major discussion item at the upcoming Toronto meeting.

But other RPM expansions touted by brand owners at the HARM event got the cold shoulder in a letter sent last week by new ICANN CEO Fadi Ch?hade to Congressional leaders (letter available at http://www.icann.org/en/news/correspondence/chehade-to-leahy-et-al-19sep12-en).

In regard to possible extension of the TMC-related claims service requirement beyond 60 days, his letter stated:

There is nothing precluding registries from electing to continue to offer the trademark claims service beyond the required 60-day period; indeed the Applicant Guidebook incentivizes registries to provide rights protections that exceed minimum requirements?.For the first round of new gTLDs, ICANN is not in a position to unilaterally require today an extension of the 60-day minimum length of the trademark claims service. The 60-day period was reached through a multi-year, extensive process within the ICANN community. One reason for this is that there are existing IP Watch services that address this needs. Those community members that designed the Trademark Claims Service were cognizant of existing protections and sought to fill gap, not replace existing services and business models. (Emphasis added)

And, on another key RPM expansion being pushed by brand owners ? going beyond exact matches of trademarks for TMC purposes ? he had this to say:

It is important to note that the Trademark Clearinghouse is intended as a repository for existing legal rights, and not an adjudicator of such rights or creator of new rights. Extending the protections offered through the Trademark Clearinghouse to any form of name (such as the mark + generic term suggested in your letter) would potentially expand rights beyond those granted under trademark law and put the Clearinghouse in the role of making determinations as to the scope of particular rights. The principle that ?rights protections ?should protect the existing rights, but neither expand those rights nor create additional legal rights by trademark law? ?was key to the work of the Implementation Recommendation Team?Though ICANN cannot mandate that the Trademark Clearinghouse provide notices beyond those required in accordance with the Registry Agreement, there is nothing to prevent the Trademark Clearinghouse or others from offering additional services that would, for example, give notice regarding various forms of a trademark. (Emphasis added)

So what is the way forward in the wake of the HARM discussion and these subsequent ICANN actions? In his opening remarks, Mr. Tonkin outlined three potential routes:

  1. 1.??? ?Best practices? implemented voluntarily by new gTLD applicants. ? This already exists in proposals from Donuts, Uniregistry, and other applicants and requires nothing from ICANN except encouragement. Registrants are free to consider whether they wish to be subject to such additional measures before acquiring a domain at any new gTLD.
  2. 2.??? ??Formal advice? to the ICANN Board from various ICANN constituencies, stakeholder groups, houses, and councils. ? In our view, advice is fine but the GNSO Council, as the ICANN entity responsible for gTLD policy, must play a central and critical role lest we see more lobbying of the Governmental Advisory Committee (GAC) by brand interests designed to circumvent the Council, with subsequent political pressure on the ICANN Board such as that which has already resulted in some whittling down in registrants? procedural rights.
  3. 3.??? A formal PDP, the results of which would be mandatory for all gTLDs. ? As Mr. Tonkin noted, this has the strongest impact but also takes the longest time. And it?s hard to envision a PDP that would consider new RPMs for presently nonexistent gTLDs as well as for those with tens of millions of domain registrations, such as .com, that could be completed prior to the expected early 2014 launch of new gTLDs.

So that?s where things stand today, but clearly more surprises could be in store in the weeks leading up to the Toronto meeting.

As ICA prepares to fully participate in that Canadian forum, our number one priority will be, ?First, do no harm ? to registrant rights.?

Latest protests against depictions of Muhammad

Here's a look at protests and events on Sunday connected to an anti-Muslim film produced in the United States and vulgar caricatures of the Prophet Muhammad published in a French satirical weekly. At least 49 people, including the U.S. ambassador to Libya, have been killed in violence linked to protests over the film, which also has renewed debate over freedom of expression in the U.S. and in Europe.

___

IRAN

Some 300 Iranian students protested against the Muhammad caricatures in front of the French Embassy in Tehran, burning French, American and Israeli flags and chanting "death to France" and "down with the U.S." They called for the expulsion of the French ambassador.

___

PAKISTAN

A mix of about 300 Christians, Sikhs, Hindus and Muslims protested against the film in the capital, Islamabad, carrying banners condemning it as they marched along a main thoroughfare near parliament. They also urged the government to ban the film.

___

BANGLADESH

Hard-line Islamic groups protesting the film enforced a nationwide general strike, closing schools and businesses and disrupting transportation. Thousands of security officials were deployed in the capital, Dhaka. No violence was immediately reported.

___

GREECE

Greek riot police used tear gas and pepper spray to disperse about 600 protesters who clashed with officers during a rally against the film. Demonstrators carried anti-U.S. banners and tried to march to the U.S. Embassy, although riot police surrounded them and attempts to break through police lines failed. Police detained six people during the rally. It was the first such protest against the film by Muslims in Greece.

Marijuana use may increase risk of testicular cancer

ScienceDaily (Sep. 10, 2012) ? A new study from the University of Southern California (USC) has found a link between recreational marijuana use and an increased risk of developing subtypes of testicular cancer that tend to carry a somewhat worse prognosis. Published early online in Cancer, a peer-reviewed journal of the American Cancer Society, the findings suggest that the potential cancer-causing effects of marijuana on testicular cells should be considered not only in personal decisions regarding recreational drug use, but also when marijuana and its derivatives are used for therapeutic purposes in young male patients.

Testicular cancer is the most common cancer diagnosed in young men ages 15 to 45 years. The malignancy is becoming more common, and researchers suspect this is due to increasing exposure to unrecognized environmental causes.

To see if recreational drug use might play a role, Victoria Cortessis, MSPH, PhD, assistant professor of preventive medicine at the Keck School of Medicine of USC in Los Angeles, and her colleagues looked at the self-reported history of recreational drug use in 163 young men diagnosed with testicular cancer and compared it with that of 292 healthy men of the same age and race/ethnicity.

The investigators found that men with a history of using marijuana were twice as likely to have subtypes of testicular cancer called non-seminoma and mixed germ cell tumors. These tumors usually occur in younger men and carry a somewhat worse prognosis than the seminoma subtype. The study's findings confirm those from two previous reports in CANCER on a potential link between marijuana use and testicular cancer.

"We do not know what marijuana triggers in the testis that may lead to carcinogenesis, although we speculate that it may be acting through the endocannabinoid system -- the cellular network that responds to the active ingredient in marijuana -- since this system has been shown to be important in the formation of sperm," said Cortessis.

The researchers also discovered that men with a history of using cocaine had a reduced risk of both subtypes of testicular cancer. This finding suggests that men with testicular cancer are not simply more willing to report a history of using recreational drugs. While it is unknown how cocaine may influence testicular cancer risk, the authors suspect that the drug may kill sperm-producing germ cells since it has this effect on experimental animals.

"If this is correct, then 'prevention' would come at a high price," Cortessis said. "Although germ cells can not develop cancer if they are first destroyed, fertility would also be impaired. Since this is the first study in which an association between cocaine use and lower testis cancer risk is noted, additional epidemiological studies are needed to validate the results."

Language, psychology and a humanistic perspective on ?Change ...

This article is about the humanistic side of ?Change Management? and will NOT deal with strategic reasons, business models or specific techniques to carry out this activity.

One of the most common phrases heard these days in Management Committees in ?innovative? organizations is that of ?Change Management?. However, as a linguist, psychologist/ psychotherapist & communication specialist with a special interest in the effects of language on mind & body, I am amazed that so few people actually understand the effects of using this type of terminology on both the mind & body of the people involved in this proposed ?Change?.

In Linguistics & Neuro Linguistic Programming, both the word ?Change? & ?Management? are defined as nominalizations which basically means that each person has their own definition of these words which may, or may not, be the same as their companions in the organization.? An easy exercise to test this is to ask a group of 6 people to write down their own definitions of ?management?, give them three minutes to complete the task and then get them to read back ONLY what they have written down. Then compare the differences!

Many psychologists, psychotherapists, psychiatrists, coaches & NLP specialists speak about ?Changework? & ?change? when working with clinical clients: An example from these areas is: ?What changes would you like to make?? yet frequently these ?Caring professionals? do not observe, notice, or place importance on the effect of these words on the client/patient. In general, people prefer to ?improve? instead of ?change?.

?Change management? explicitly indicates that there is a need to change and that IT IS going to happen? The decision has been made! However, many people believe that if something has been working more or less effectively for a period of time and has always worked, why is there this newly identified, sudden & urgent need to change? There is also an explicit understanding that whatever is currently being done is ineffective, poor, weak, unprofessional, or lacking in some way & can be taken as a direct, or indirect , comment or criticism of the employees in the organization..

Our studies with both business & clinical clients indicate that when people hear the word ?Change?, they immediately start thinking about the following areas (in no particular order):

Fear: Change involves new, known &/or unknown risks in the short-, medium- & long-term and, generally, everyone likes to reduce risks to the minimum. These fears might involve feelings of inadequacy, job security, future prospects within the organization, etc. There are enough risks around us without looking for more in the work environment!

New: Change generally requires learning new skills;? abilities; techniques; structures; systems; ways of working and the modification of ?tried & trusted? working practices. The people affected by the change will be asked to forget what they have learned & done ? often after many years of use and, from their point of view, effective functioning. People who have been performing the same function in the same way over a period of time have acquired a level of psychological security which is often lost when change is announced or actually occurs.
This has been identified as ?The Einstellung Effect? which posits that:
?After learning to solve a problem one way, we are blind to other more efficient methods.?

Change in power or status:
Change is always accompanied by a perceived or actual loss, or gain, in power or status. People generally have a perception of their relative power or status within any organization, whether it be in a business or family context, and this directly affects their methods of interaction with other components in this unit. When change occurs it requires the people involved to modify their own self-perception and perception of others; find new ways of interacting with co-workers; develop new skills and abilities and psychologically adapt to the changes in power & status.

More/less responsibility.
Change is often accompanied by an increase or decrease in responsibility which may or may not be accompanied by adjustments to the employees? salaries. Not everyone wants to have additional responsibilities thrust upon them or, conversely, have responsibilities taken from them which could be seen as a ?demotion? or punishment by coworkers.

Resistance from some and Acceptance from others.
There are certain types of people who are resistant to change and will often fight tooth-and-nail against it. There is another large group of people who have absolutely no problems adopting change ? even on an almost daily basis! The third, and smallest,? group need much more time to accept, assimilate & incorporate change into their ?whole being? than the two previous groups.

New ?strange? abilities required?
In some case ?change? means that the people involved need to develop new abilities that they might feel are strange or difficult for them to acquire or perfect: one example is that of using Information Technology (computers, etc.) or Social Networking, etc.

Excessive / Incomplete / insufficient information.
In many organizations there are usually three tendencies followed when dealing with !Change?:
1.?? ?Keep all the information about what, where, when, why, how, who, etc., secret until the launch date so that everyone get ALL the data in one gigantic information overload.
2.?? ?Start with small / minor ?cosmetic changes? or mini-projects without revealing the overall grand design of these elements. This is something that encourages the rumour factory in the organization to function overtime.
3.?? ?Start the process without telling the people affected what the aims, objectives and steps involved which creates the perception that it is ?insignificant?.

Pressures: time, etc?
Frequently ?change? is based on a timetable of activities and actions which are fixed by the ?Change Manager? and must be completed On Time! This is a nice, highly structured, little system for some people (about 12% of the population), however, for another part of the population, the pressure of time, completion dates, etc., can cause stress which can undermine any activities that directly affect them or their environment.

For many people, it is easier to reject than to change This rejection can lead to a reduced level of? commitment to the changes being implemented with negative effects on the organization.??

As we can seem from the information above, I would like to propose that instead of using the phrase ?Change Management? in our organization, we use the phrase ?Improvement Management?

The phrase ?Improvement Management? is generally seen as being much more positive, non-threatening, more effective, more motivational and easier to process psychologically which helps the organization move forward in its plans for development & innovation.

In the second article related to this topic we will deal with some of the common errors encountered in this process.
